These Terms of Service ("Terms") govern your access to and use of jekcms software and services provided by ALFA Dizayn ("Company", "we", "us"). By purchasing, downloading, or using jekcms, you agree to these Terms.

1. License Grant

Upon purchase, we grant you a non-exclusive, non-transferable license to install and use jekcms on the number of domains specified in your plan. Licenses are per-domain; each production website requires its own license unless your plan explicitly states otherwise.

2. Permitted Use

• Install and operate jekcms on your own websites
• Modify the source code for personal or client projects
• Use jekcms to build and deliver websites to your clients

3. Prohibited Use

• Resell, redistribute, or sublicense the software
• Remove or obscure copyright notices or license keys
• Use jekcms to build a competing CMS product or template marketplace
• Reverse-engineer the licensing system
• Share your license key with third parties

4. Payment and Billing

All prices are listed in USD unless otherwise stated. Taxes may apply based on your location. Payments are processed by our payment partners. We issue electronic invoices via email. Annual licenses are billed upfront; monthly licenses are billed each billing cycle.

5. Refund Policy

We offer a 14-day money-back guarantee for first-time purchases. Refund requests must be submitted within 14 days of the original purchase date via our support system. Renewal payments are non-refundable unless the service was unavailable for more than 72 consecutive hours.

6. Updates and Support

Active license holders receive software updates and priority email support for the duration of their license period. Updates include bug fixes, security patches, and new features. We do not guarantee backward compatibility for major version upgrades.

7. Uptime and SLA

We target 99.9% uptime for jekcms.com and license verification servers. Planned maintenance will be announced at least 24 hours in advance. We are not liable for downtime caused by third-party services, DDoS attacks, or force majeure events.

8. Intellectual Property

jekcms software, branding, and documentation are the intellectual property of ALFA Dizayn. You retain ownership of content you create using jekcms. You grant us no rights to your content.

9. Disclaimer of Warranties

jekcms is provided "as is" without warranty of any kind. We do not warrant that the software will be error-free or that it will meet your specific requirements. Use at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, ALFA Dizayn shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of jekcms. Our total liability shall not exceed the amount you paid for your current license period.

11. Termination

We may terminate or suspend your license if you breach these Terms. Upon termination, you must cease using the software and remove it from all websites. Refunds upon termination for cause are at our discretion.

12. Governing Law

These Terms are governed by the laws of the Republic of Turkey. Disputes shall be resolved in Istanbul courts.
