Terms of Service

These terms govern the use of jekcms.com, the customer account, licence purchases and add-on services. Installing and using the jekcms software is governed by the End User License Agreement (EULA). Where the two conflict on the use of the software, the EULA applies. The Turkish version of these terms is the binding text; this English version is provided for convenience.

1. Parties

The service provider is Celil Uyanıkoğlu (ALFA Dizayn Web Tasarım ve Yazılım), a sole proprietorship in Türkiye. Tax details and address are on the Legal notice page. "You" means the individual or legal entity that uses the site, opens an account or makes a purchase.

2. Account

• You must give accurate details when opening an account and keep them up to date.
• You are responsible for keeping your password and licence key secret. Tell us at once if you notice unauthorised activity in your account.
• You can delete your account on the Security page of the customer panel. Records we must keep by law (invoices, contract acceptance) are kept for the periods stated in the Privacy Policy.

3. Purchase and payment

• For licence and add-on purchases, payment is taken by Polar Software, Inc. acting as reseller (Merchant of Record). In these orders Polar is the party that sells the product to you, issues the invoice and handles sales tax; Polar's own terms also apply at checkout. Your card details never reach us.
• For payments by bank transfer, we are the seller and issue the invoice.
• Prices are shown on the pricing page. Each plan shows its discounted first-year price and its renewal price. Taxes may be added at checkout depending on your country.
• Paid licences are valid for one year. When the term ends your site keeps running and moves to the free edition; see Section 2.9 of the EULA.

4. Withdrawal and refunds

A licence is an intangible good delivered instantly in electronic form once payment is confirmed. Under Article 15(1)(ğ) of the Turkish Distance Contracts Regulation there is no right of withdrawal for such contracts. Refund terms are set out in the Refund Policy. For orders it takes as reseller, Polar reserves the right to issue refunds under its own terms and at its own discretion. Consumers in other countries keep any mandatory rights their local law grants.

5. Add-on services

Installation, WordPress migration, hosting and monthly care are chosen at checkout; their scope and price are shown on the checkout page. These services require access to your site, server or content. While providing them we process personal data on your site on your behalf and only on your instructions, under the "Processing personal data in add-on services" section below.

In the hosting service (jekcms Hosting) the server infrastructure is provided by Hostinger International Ltd.; jekcms rents this infrastructure from Hostinger and acts as an intermediary. We install, update and maintain your site; operating the servers, network connectivity and physical security are Hostinger's responsibility. The servers are in the United Kingdom. As the content provider you are responsible for the content published on your site.

6. Support

Support is provided through tickets opened in the customer panel, on business days. There is no 24/7 support. The scope and duration of support depend on your licence plan.

7. Acceptable use

You may not use the site or services for unlawful purposes, attempt to harm the system or access other people's accounts, or overload the site with automated tools. If these rules are broken we may suspend your account.

8. Legal obligations on your site are yours

You own and operate the site where you install jekcms. You are the data controller towards your site's visitors, members, commenters and subscribers. Complying on your site with data protection law (KVKK, GDPR and the law of the countries your site targets), cookie and consent rules, rules on commercial electronic messages, consumer law, copyright and content law is your responsibility. The tools jekcms provides, such as the cookie notice, the legal page generator and retention settings, exist to help you meet these obligations. They are not legal advice and do not guarantee that your site complies with the law. See the "Data protection and legal compliance" section of the EULA.

9. Limitation of liability

The site and services are provided with reasonable care and as is. We do not guarantee uninterrupted or error-free operation. To the extent permitted by law, we are not liable for indirect damage (such as lost profit, lost data or business interruption), and our liability for an order is limited to the amount you paid for that order in the last 12 months. These limits do not apply in cases of intent or gross negligence or to liability that cannot be limited by law.

10. Changes

We may update these terms. We show the date of the change at the top of the page and announce important changes by email. Changes apply to new orders and renewals made after the notice; they do not work against you for a period you have already paid for.

11. Governing law and jurisdiction

These terms are governed by the law of the Republic of Türkiye. The courts and enforcement offices of Ankara have jurisdiction. If you are a consumer, your right to apply to the consumer arbitration committee and consumer court of your place of residence, and any mandatory protection of the law of the country where you live, remain unaffected.

12. Processing personal data in add-on services

This section applies when we access personal data on your site while providing add-on services (installation, migration, hosting, care) or support. You are the controller and we are the processor (KVKK Art. 3(1)(ğ); GDPR Art. 28).

1. Scope: Personal data in your site's database and files (such as visitor, member, commenter, subscriber and contact form records) is processed only to deliver the ordered service or your support request, and only for the duration of the service.
2. Instructions: We process the data only on your documented instructions (order, support ticket, email); we do not use it for any other purpose or share it with anyone. If the law requires a disclosure, we tell you in advance unless that is prohibited.
3. Confidentiality: Only the person doing the work accesses the data, under a duty of confidentiality.
4. Security: Access details you give us (panel, FTP, database) are used only while the work is done, and we ask you to change them afterwards. We take the technical and organisational measures required by KVKK Art. 12 and GDPR Art. 32.
5. Sub-processors: In the hosting service your data is stored on servers of Hostinger International Ltd. (United Kingdom). We will tell you before using any other sub-processor and give you the chance to object.
6. Assistance: We give reasonable help so you can answer requests from your visitors and meet breach notification duties. If we learn of a breach under our control, we tell you without undue delay.
7. End of service: When the service ends we delete or return copies of your data we hold (backups, export files), except what we must keep by law.
8. Audit: On request we provide the information needed to show that we comply with this section.

If you only use the software without buying a service, we do not access the content or database of your site. The technical data your jekcms installation sends to our licence server (such as licence key, domain and version details) is data we process as controller; it is listed in the Privacy Policy.
